1. Acceptance of Terms
By accessing or using the WilderBound application ("App"), website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
WilderBound provides a mobile and web-based scenic route discovery and trip planning platform that includes route optimization, itinerary building, offline map access, real-time safety features, fuel tracking, and group trip coordination tools. The Service may include free and premium subscription tiers with varying levels of functionality.
3. User Accounts
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. WilderBound reserves the right to suspend or terminate accounts that violate these Terms.
4. Permitted Use & Restrictions
You may use the Service solely for personal, non-commercial trip planning. You agree not to: (a) reverse engineer, decompile, or disassemble any part of the Service; (b) use the Service for any unlawful purpose; (c) redistribute or resell any part of the Service; (d) interfere with the Service's infrastructure; (e) scrape, harvest, or collect data from the Service without written consent; (f) upload harmful, abusive, or infringing content; or (g) misuse location or safety features.
5. User Content
You retain ownership of content you submit. You grant WilderBound a non-exclusive, worldwide, royalty-free license to host, display, and process that content to operate and improve the Service.
6. Subscriptions & Payments
WilderBound offers both free and premium subscription plans. Premium subscriptions are billed on a monthly or annual basis through the Apple App Store or Google Play Store. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Refunds are subject to the policies of the respective app store platform.
7. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio, software, and code — are the exclusive property of WilderBound and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes.
8. Disclaimers & Safety
WilderBound provides route suggestions and safety features as informational aids only. The Service does not replace the need for attentive, safe driving. Route information, traffic data, weather alerts, and road conditions may not always be accurate or current. You are solely responsible for your driving decisions. WilderBound is not liable for any accidents, injuries, or damages resulting from reliance on the Service. The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by applicable law, WilderBound and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
10. Third-Party Services
WilderBound may integrate with third-party tools and data providers. We are not responsible for third-party content, services, accuracy, or availability. Their use is governed by their own terms and policies.
11. Termination
We may suspend or terminate your access to the Service if these Terms are violated or if needed to protect users, the Service, or legal rights.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California.
